These General Conditions for Publication, henceforth simply named "GCP", regulate the publication of contents in POLIS website, henceforth simply named "Site". The denominations “Innovative”, “Searcher”, “Advertiser”, “Search advertiser” or “Offers advertiser” are all related to the Customers of the Site which publish their advertisements. By publishing an advertisement in the Site, the advertiser shall be over 18 years old and be legally able to accept the GCP. Should the advertiser be accessing the Site on the behalf of an entity or legal/collective person, he shall ensure that he is authorized to accept the GCP on the behalf of the corresponding entity or legal/collective person, as well as he should guarantee that this entity or legal/collective person agrees to indemnify POLIS for any violation of the GCP. Due to the own nature of information carrier of the advertisers, this Site will not take any responsibility for the information rendered and the commercialization of the products, services and ideas advertised, being that the corresponding advertisers will be solely responsible for them. In no case POLIS acts as middleman at the transactions that may be made from the advertisements published in the Site, being limited to their publication, confident on the good faith of those who request or contract their insertions. For these reasons, POLIS will not take any responsibility for the veracity, quality or origin of the contents of advertisements published in the Site. Any and all content or service carried out by other enterprises and disclosed in the Site through advertisements, guidelines, tips or hyperlinks can not be changed or distributed, published or used for commercial purposes by any user without previous authorization of the advertiser, as well as of POLIS. The brands, logos, layouts, designation of services and all material of this Site are the intellectual property of POLIS being forbidden their use by third parties without the previous authorization of the POLIS Board of Directors.

By publishing a content in the Site, the advertiser declares:
a) That he is the owner and/or controller of the content rights he publishes and/or has the right to publish this content in the Site;
b) That the content is exact and clear and;
c) That the use and publication of the content does not violate the GCP nor infringe the rights or cause damages to any physical/individual and/or legal/collective person.

The advertiser also agrees, as user of the Site POLIS, not to publish in the Site any of following materials:
a) Messages, comments, information, texts, lyrics of songs, pictures, graphical elements, codes or any other illegal, slanderous, vilifying, obscene, pornographic, harmful for minors, threatening, false, that violate privacy rights, abusive, fraudulent or questionable at any other way;
b) Contents that constitute, encourage or deliver instructions for a criminal offence, violate the rights of third parties, that might adulterate the civil responsibility or that at any other way infringe local, state, regional, national or international Acts;
c) Contents that might violate patents, trade marks, commercial secrets, author rights or any other intellectual property right of POLIS or of third parties, or any other kind of material reproduction without the previous authorization of the owner.
d) Contents that contain viruses, corrupted data or other component that might cause damages, being harmful, destructive, permanent or temporary to the equipment of the destination, of POLIS or its hired hosting providers;
e) Contents that, at POLIS exclusive discretion, are questionable, restrict or constrain third parties during the use of the Site or that might expose POLIS or its users to damages or liabilities of any kind.

By publishing contents in the Site, the advertiser states being legitimate and/or authorized to transmit, distribute and reproduce these contents; besides own or third parties private information, mail addresses, telephone numbers, e-mail addresses, tax payer identification numbers and credit card numbers.

Furthermore, as user of the Site, also agrees to following conditions:
a) Not to record/inscribe himself with false information or of not-authorized third parties properties;
b) Not to send or transmit any kind of information which is property of third parties without authorization;
c) Not to change, delete or corrupt data and information of third parties;
d) Not to violate the privacy of other advertisers;
e) Not to use addresses of computers, of nets or of false electronic mail; The advertiser is the only responsible for creating backup copies of any content he publishes in the Site. POLIS is not responsible for keeping safeguard copies of the contents published in the Site. POLIS also does not take any responsibility for the maintenance of the contents of the Site other than the terms agreed at the purchase according to the modalities of the “ads” and is entitled, at its exclusive discretion and without any previous communication, to remove contents published in the Site after those terms.

Licenses and authorizations

The advertiser recognizes and agrees that POLIS can access, use or disclose information about itself or about its use of this Site, including, but not limiting to any content published in the Site, to divulge its works or to comply with the law or legal establishments.

By publishing contents in the Site, the advertiser grants POLIS the non-exclusive, free of charge, everlasting, irrevocable and incontrovertible right of use, reproduction, adaptation, publication, translation, distribution, execution and exhibition of these contents on the whole world and in any diffusion/media means.

Indemnity

The advertiser of POLIS Site agrees in defending, indemnifying and keeping safe POLIS, its collaborators, agents, third party information providers and suppliers, not depending of any claim, damage, cost, responsibility and/or expenses, including attorney’s honoraries, originated or related to any undue content or not complying with the GCP, which he (the advertiser) publishes in the Site.

Cancellation

POLIS reserves the right of, without previous communication and at its exclusive discretion, terminating the record/inscription of the advertiser or its account, blocking its publications or removing the content published in the Site, should it not accomplish any item described in the GCP.

Validity and effectiveness of the clauses

Any renunciation or change of the GCP instruments shall only become effective if presented in written and signed by POLIS. Should a GCP clause become void or deemed as not-applicable, the other clauses shall remain valid and effective, whenever possible.

Changes of the GCP

POLIS reserves the right of changing the GCP, as well as any other policy of the Site, at any time and at its exclusive discretion. The changes shall be in force at the moment of the corresponding publication in the Site. The use of the Site after the publication shall constitute acceptance of eventual changes. Therefore, we recommend the advertisers to read the GCP every time they visit our Site.

Law and applicable Legal Court

Any litigation related to contents published in the Site shall be submitted to the Civil Court of the District of Lisbon, Portugal, which shall prevail over any other even more privileged, and will be judged according to the laws of Portugal. Privacy Policy

This document is part of a set of actions established by POLIS aiming to respect and preserve the right of identity secrecy of each advertiser. Individual identity shall be understood as any information that is not available for the public in general and that, if disclosed, can cause any kind of moral constraint, damages or prejudice to the person itself or to the enterprise the person represents.

By using the various kind of services offered through Internet, we usually provide personal information to the sites through which we browse. Through this document, POLIS intends to clarify our advertisers how this information is gathered by us and which purpose it is destined to.

In order to have a better knowledge of our advertisers and so being able to offer a more and more efficient service addressed to the persons who use it, we might eventually request the filling out of an online research form/investigation, always answered in a voluntary way. Furthermore, the operations carried out with the use of the Site are systematically registered, including the time of the transaction, the IP address of your station (this is a number automatically assigned to your computer every time you connect to Internet), the identification of the advertiser (if registered/inscribed) and the operation carried out.

These data are exclusively destined to a better service of the universe of persons which use our Site in order to offer an efficient service suitable to the requirements of each one of our advertisers. POLIS will not disclose individual data of its advertisers without their express consent for it, though data of the general population of our advertisers are normally disclosed, or their sub-assemblies, as geographical distribution, by age range, gender or other characteristics or general preferences, without identifying them individually.

POLIS also ensures that no information is transmitted to third parties for use in correspondences, direct mail advertising or lists of e-mails without the express authorization of the advertisers. Likewise, e-mails sent by us to our advertisers have the only purpose to rendering information pertaining to the service offered, as communicate changes and send notices or information requested by the advertiser. Due to the nature of our operations, we also inform that such e-mails can contain advertising messages.

Responsibilities of the advertiser
a) To be careful with the data of its individual identification whenever Internet is accessed;
b) To deliver actual information and of its certification or responsibility;
c) To be responsible for any kind of information or statement originated with its username and password;
d) To keep its username and password under secrecy;

Author and Trade Marks Rights

The intellectual property of any material presented in the Site is of POLIS, or of its advertisers, Customers, partners and suppliers, including programs, data bases, images, files or any other kind of materials and which are contractually authorized for diffusion in this Site.

Without the previous written authorization of above identified responsible, it is forbidden the reproduction of any material of the Site, in this case reproduction meaning all possible ways of copies and distribution. The trade marks presented in the Site are property of POLIS or of its advertisers, Customers, partners or suppliers, being that the simply presentation of the marks in the Site can not be seen as concession, the use or any kind of reproduction of such trade marks being equally forbidden. The unauthorized use of intellectual property or trade marks presented in the Site will be characterized as violation of the author and/or trade marks rights regulations and shall subject the offender to the applicable legal actions. The images are merely for illustration purposes and have been produced by POLIS, advertisers, Customers, partners and suppliers.

POLIS Commitment

POLIS is committed to:
a) Record/inscribe in its Site only the information about individual/singular or legal/collective identifications required for the viability of their businesses and to the supply of products and/or services requested by its advertisers.
b) Request authorization to send information or promotional material to the electronic mail of the recorded/inscribed advertisers in its Site;
c) Allow the cancellation of the previously authorization given to send information or promotional material;
d) Rigorously comply with all establishments of this Privacy Policy and Data Security.

Privacy of Data

By choosing authorize us access to your personal information, you allow us keeping this information in our data bases in a protected and safe way.

By recording/inscribing in the Site, depending on the performed action, information is requested about:
a) Individual identification of the advertiser;
b) Purchase and payment method of the in the Site requested product or service;
c) Preferences of the advertiser;
d) Opinions of the advertiser or of the internauts in general;
e) Access of the advertiser (example: date and time of the access);
f) Access profile of the advertiser (example: links clicked, pages visited).

Use of Data

The information captured through the Site is used with the purpose of:
a) Allowing the advertisers to browse or perform operations made available in the Site;
b) making viable the supply of products and services of the Site;
c) identifying the profile, preferences, desires or needs of the advertisers, in order to enhance the offered products and/or services; ^
d) carrying out generic statistics;
e) sending newsletters, promotions and information about products or services interesting to its advertisers;
f) divulging changes, innovations or promotions about the products and services of POLIS and partners.
g) investigating problems;
h) encouraging safe businesses and reinforcing our policies;
i) qualifying advertisers by experience and level of interest and informing them about our services and updates;

Disclosure of Data

POLIS does not provide to third parties information about the individual identification of recorded/inscribed advertisers without their precious consent. Excepted are the cases where there is a legal order for supplying the data.

Besides above mentioned cases, should the need or the interest exist for transmitting to third parties the individual identification data of advertisers, POLIS will request their previous authorization. Information which are not of individual identification (as demographics, for instance) can be transmitted to advertisers, suppliers, sponsors and partners with the goal of enhancing the quality of the products and services offered by POLIS. Third parties who eventually receive from POLIS information of any nature about the internauts which access its Site are likewise obliged to equal respect to these conditions.

We can share personal information in order to: respond to legal requests; reinforce our policies; respond to complaints of an advertiser which violates the right of others; or to protect the right, property or safety of any user.

We also can share personal information with:

a) Associated Corporations which help us to detect and prevent potential illegal actions and to provide services in common;
b) Suppliers of services essential to our operations.

Guaranty of Privacy

It is possible accessing sites and portals of other enterprises from POLIS Site, being that each enterprise has own policies to ensure the secrecy and the data protection. Therefore, we emphasize that this policy is applicable only to the Site of POLIS, whereby the advertiser is the only responsible of getting informed about the policies for preservation and protection in force for the remaining sites.

POLIS is expressively committed in providing security and secrecy to the information gathered. However, to ensure efficiency to the adopted measures, each advertiser is also required to a responsible behavior, being careful with the data of its identification each time the Internet is accessed, only informing them in operations which have data protection, and never disclosing its advertiser identification and always disconnecting the account from the Site as soon as exiting the Web, specially when sharing the computer with another person.

Should it be noticed that this Privacy Policy and Data Security is not being complied with, the detected non-conformity may be indicated to the responsible via the address contact@poliscenario.com.

Data Security

Performed payment related transactions, not depending on the chosen way, are carried out in a secure environment certified by an enterprise specialized in data security for internet.

Another security measure is not registering the number and the validity date of the advertisers credit card, nor other information specific for the payment to POLIS. These data is informed directly to the financial institutions and are not stored nor used by POLIS to another purpose.

At some points of the Site, individual/singular or legal/collective and/or cadastre identification information is gathered (such as full name or trade name, address, telephones, etc.) required for browsing or use of the available services. The identifiable information gathered by POLIS, is only handled by authorized personnel. The operations carried out in the Site by an advertiser, as well as the information associated to these operations, are exclusive and can only be accessed by that advertiser.

Identification of the advertiser

By recording/inscribing in the Site for the purchase of products or services (paid or not), each advertiser receives a unique identification, which is required and authenticated at the further accesses to the site, being established that this identification, for legal purposes, serves as agreement signature to any proposal made in this Site. The advertiser identification is exclusive and not-transferable, being stored in data bases of the enterprise hired by POLIS for data hosting.
